   Advisory Opinion No. 150

This advisory opinion concerns the subject of using City assets for private purposes.

Revised Charter of Honolulu 1973 (1983 Ed.) Section 11-102.3 states that:

No elected or appointed officer or employee shall:

. . . .

3.   Engage in any business transaction or activity or have a financial interest, direct or indirect, which is incompatible with the proper discharge of his official duties or which may tend to impair his independence of judgment in the performance of his official duties.

In light of the current City-wide interest in the issues surrounding a possible recall of City officials, the Ethics Commission reminds all City officers and employees that it is incompatible with the discharge of the official duties of any officer or employee to use City equipment and facilities for purposes other than City business or to spend time during office hours working on matters other than City business.
