Advisory Opinion No. 28
This is in reference to the conflict of interest disclosure submitted by Employee X, an employee of the Board of Water Supply, regarding his real estate sales activity.
At an investigative hearing conducted by the Commission, Employee X testified that he confined all of his real estate activity on the Island of Hawai‘i.
Under the foregoing circumstances, we are of the opinion that there is no conflict of interest existing which would require the inactivation of Employee X's real estate license. There is no conflict of interest because the real property interest he buys and sells is not within the jurisdiction of the City and County of Honolulu. Since it is not within the jurisdiction of the City and County of Honolulu, he cannot be said to take advantage of his employment, position or have special information to enhance his personal interest.
