Advisory Opinion No. 32
This is in reference to your letter of March 1, 1972 in which you requested the Ethics Commission to render an opinion on the disclosure of interest by Officer X who is employed by the Police Department and is a shareholder in company Y. He is also a member of the board of directors.
The Ethics Commission concurs with your finding that there is no conflict of interest in the instant case, unless Company Y has direct dealings with the City and County of Honolulu, such as seeking a building permit- subdivision of land or rezoning of land. At such time, Officer X should submit a disclosure of conflict of interest. In short, the mere financial interest held by Officer X in said company does not give rise to a conflict of interest.
