Advisory Opinion No. 38
This is in reference to the disclosure of outside employment submitted by Employee X who is employed as Land Surveyor.
After reviewing the statements in the disclosure and interrogating Employee X, the Ethics Commission has found that:
1. Employee X has interests in land developments conducted by Y Development Co.;
2. As a Land Surveyor, he does survey work only on City land or land contemplated to be acquired by the City; and
3. Employee X does not survey any land that is subject to review by the City agencies as land development such as the subdivision or planned unit development.
In view of the foregoing, the Ethics Commission concludes that there is no conflict of interest in connection with the interest held in Y Development Co. by Employee X.
