Advisory Opinion No. 39
This is in reference to the disclosure of outside employment submitted by Employee X who is employed in your Department as a Senior Electrical Inspector.
After reviewing the statements in the disclosure and interrogating Employee X, the Ethics Commission has found that:
1. Employee X has interests in land developments conducted by Y Development Co.;
2. As an Electrical Inspector he is in a specialty class and devotes all of his inspectional work to the electrical system in the high rise constructions located within the district of Honolulu; and
3. Y Development Company has no high rise construction within the district of Honolulu.
In view of the foregoing, the Ethics Commission concludes that there is no conflict of interest in connection with the interest held in Y Development Co. by Employee X. We recommend that Employee X should at no time be assigned to areas where Y Development Co. has real estate development.
