Neighborhood Commission



MONDAY, OCTOBER 28, 2013   



CALL TO ORDER: Chair Sylvia Young called the hearing to order at 7:10 p.m.; the meeting was delayed due to exigent circumstances (due to a rally at the Capitol that caused major traffic delays in the area).



Members Present – Tyler Dos Santos-Tam, Robert “Bob” Finley, Kathleen Pahinui, Robert “Bob” Stubbs, Claire Tamamoto, Russell Yamanoha, and Sylvia Young. 


Members Absent – Loryn Guiffre and Charles Zahn.


Guests – Bert Narita (Member, Diamond Head NB No. 5), Laura Yoshida (Deputy, Corporation Counsel), Nicole Velasco (Executive Secretary), Romeo Garcia, Bryan Mick, Marie Richardson (Neighborhood Commission Office staff).  


ROLL CALL OF COMMISSIONERS, ESTABLISHMENT OF QUORUM:   A roll call of Commissioners established a quorum of seven (7) members present.


ADJUDICATION HEARING ON COMPLAINT NO. 1103-#36-06 – KAOPUA v TERUYA – Before calling the hearing to order, Chair Young took a quick roll-call of the parties:  John Kaopua (absent) and Patty Kahanamoku Teruya (absent).


This contested case hearing was called to order on Monday, October 28, 2013 and the time now is 7:10 p.m. The Commission is here today to hear reason(s) why the Commission should or should not issue sanctions, for the following complaint: Complaint No. 1103-#36-06 (filed on March 21, 2011) by John Kaopua III for alleged violations of the 2008 Neighborhood Plan, §2-14-126 Parliamentary Authority.


The Complainant and Respondent have received the proper notice for the hearing pursuant to the Hawaii Revised Statutes Section 91-9 and 91-9.5.


Being that the complainant and respondent were not present, Chair Young entertained a motion:  Finley moved, Pahinui seconded to dismiss Complaint No. 1103-#36-06. The motion to dismiss was ADOPTED by a vote of 7-0-0 (Aye:  Dos Santos-Tam, Finley, Pahinui, Stubbs, Tamamoto, Yamanoha, and Young). 


ADJOURNMENT:  The hearing adjourned at 7:14 p.m.
