FEBRUARY 28, 2002 

          Corporation Counsel Dave Arakawa released the following statement today regarding the issue of the HFD audio tape: 

          “The City is troubled by the fact that since Plaintiffs have a weak case, they feel compelled to invade the province of the court and try their case in the media. The City is not a defendant in this case and never has been. Plaintiffs originally sued 12 individual City or former City employees. Of these 12 individuals, only three remain in this case—the Court dismissed three of these individuals and Plaintiffs voluntarily dismissed six others. 

“With regard to the audio recording of which the Plaintiffs complain, Fire Department officials followed the normal procedures for obtaining a copy of the radio transmissions which were requested by the National Training Safety Board. Other than to say that the Plaintiffs’ complaints regarding the audio tape have already been considered by the Court in a previous proceeding and ruled upon, the City declines further comment.”
